What is Tradiator's ADR system?
ADR, or Auction Dispute Resolution, enables two parties involved in a dispute over an auction transaction to file a case with Tradiator and work to resolve their issue using a private message board to discuss a compromise. The ADR service is completely web-based and capable of handling disputes between parties based in different countries.
How does the process work?
First you'll need to file a case online. Within 24-48 hours, you and the other party will receive a login to your private case page. Login to your page and enter the messaging area to discuss your dispute. In the event that you cannot work out a resolution, request a mediator.
When should I file a case?
File a case with Tradiator if you have made unsuccessful attempts to resolve an auction transaction dispute on your own.
Who should file the case?
Either the seller or the bidder may file. You must be directly involved in the transaction for which you are filing.
How long does the process take?
It varies with each case, but usually a resolution can be negotiated in a matter of days. However, the length of the process depends on how quickly you and the other party respond to messages. The more quickly you respond and provide the needed information, the faster your case will be resolved. For cases in which a compromise cannot be found, we recommend our mediation services.
How much does it cost?
Our basic dispute resolution services are offered FREE of charge! If you and the other party are unable to resolve the issue on your own, you can request a mediator to help you reach a satisfactory solution for a reasonable mediation fee.
Why should I file a case with Tradiator?
If you have bought or sold something online and have had problems such as getting what you bought, or getting paid, you can file a case. Tradiator will work with both parties to try to resolve your dispute without turning to the legal system or other costly, time consuming processes to resolve your claim. Tradiators ADR system allows you to work the problem out online at whatever time of the day or night is most convenient for you.
Am I starting a lawsuit if I file a case with Tradiator?
No, you are not filing a lawsuit. Tradiator is not a court of law.
Why use the ADR System and Mediation?
When disputing parties have the opportunity to craft their own solutions to a problem, they are more likely to comply with the agreement. Mediated settlements typically provide more durable and satisfactory resolutions than decisions that are rendered by the court system. The process is also less expensive and faster than litigation.
What happens if the other party chooses not to participate?
In the majority of cases, both parties in a disagreement want to work toward a solution. Tradiator works diligently to encourage the other party to respond to a case, but we cannot guarantee participation, since the process is completely voluntary. If there is no response to our notices after 14 days, most parties will not participate. At that time, Tradiator will consider the case closed. If the other party chooses to respond thereafter, the case will be reopened.
Is Tradiator an independent operation?
Tradiator is a completely independent, totally unbiased third party with impartial processes and systems. Our highly-trained mediators and arbitrators are also independent; their actions and recommendations are driven only by professional judgment and rules of fundamental fairness and general commercial principle. Neither Tradiator nor our network of mediators will ever profit from any particular decision.
If I choose to pay for mediation, will the mediator be my representative?
No, the mediator is a neutral person who is there to help you and the other party. The mediator will not be your representative and will not try to convince the other party that you are right just because you filed the case. If you request a mediator, you will pay a reasonable mediation fee to use the service.
Why respond to a notice from Tradiator?
Responding gives you and the other party a chance to resolve the problem, avoiding other types of claims or legal proceedings that a party may pursue in order to resolve their dispute. It also helps to preserve your reputation as an online buyer or seller. It demonstrates your honesty and shows that you have nothing to hide. Responding is quick, easy and FREE.
What happens once I respond to this case?
Your information about the situation and your response to the other party's concerns will both appear on the case page, and you will both have a chance to work out the problems in the password protected secure case page on our site. If you are not able to work it out together on your own, then the either party can request a Mediator.
The case is assigned to one of Tradiator's trained and experienced mediators. The mediator communicates with the parties right on their private message board. The mediator's role is to encourage positive, solution-oriented discussion between the parties.
What happens if I do not respond to this case?
Tradiator notifies you about the case to encourage you to resolve the problem with the other party, but cannot force you to participate. However, the other party may pursue a few options if you do not respond.
If this is an eBay case, and the other party requested feedback removal as part of the case, and you do not respond, then the feedback might be removed anyway in accordance with eBay's Feedback Removal Policy.
The other party may also pursue claims through insurance, credit card charge backs, or legal processes which may cost you more time and money. If you do not respond, it may affect your reputation in the marketplace.
